HEIST NIGHTS — TERMS OF SERVICE Last updated: September 8, 2026

1. Acceptance of Terms

By downloading, installing, or using the Heist Nights mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Heist Nights ("we," "us," "our").

2. Eligibility

You must be at least 13 years of age to use the App (16 within the EEA). By using the App, you represent that you satisfy this age requirement. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activity occurring under your account.
You must notify us immediately at admin@heistnights.com if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

Post content that is unlawful, threatening, harassing, defamatory, obscene, or hateful
Impersonate any person or entity
Use the App to distribute spam, phishing content, or malware
Attempt to hack, reverse-engineer, or disrupt the App or its underlying infrastructure
Employ bots, scrapers, or other automated means to access the App
Buy, sell, or trade user accounts
Disclose another person's private information without their consent
Use the App for commercial purposes without our prior written consent
Violate any applicable local, national, or international law

Violation of these provisions may result in immediate account suspension or permanent termination without refund.

5. User-Generated Content

You retain ownership of content you post ("User Content"). By posting User Content, you grant Heist Nights a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute that content within the App and for promotional purposes related to the App. You represent that you own, or otherwise possess the necessary rights to post, your User Content, and that it does not infringe the rights of any third party. We reserve the right, in our sole discretion, to remove any User Content that violates these Terms or our Community Guidelines.

6. Purchases and Refunds

All purchases made through the App (merchandise, in-app items, drops) are processed securely via Stripe.
Digital items (in-app purchases, drops) are non-refundable once delivered, except where required by applicable law.
Physical merchandise may be returned within fourteen (14) days of delivery, provided the item is unused and in its original condition. Contact admin@heistnights.com to initiate a return.
We reserve the right to modify pricing at any time. Price changes do not affect purchases already completed.

7. Intellectual Property

All content within the App that does not constitute User Content — including, without limitation, the Heist Nights name, logo, design, graphics, source code, and text — is owned by or licensed to Heist Nights and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from such content without our express written permission.

Game names, logos, and artwork referenced within the App are the property of their respective owners. Heist Nights is not affiliated with, endorsed by, or sponsored by any game publisher unless expressly stated.

8. Live Streaming and Real-Time Features

Live streams and real-time chat are subject to our Community Guidelines. We reserve the right to terminate any live stream that violates these Terms without prior notice. You are solely responsible for content you broadcast via live stream.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEIST NIGHTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Heist Nights and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections 5, 7, 9, 10, 11, and 13 survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the App shall first be addressed informally by contacting admin@heistnights.com. If unresolved within thirty (30) days, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association, provided that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notification or email. Continued use of the App following the effective date of such changes constitutes acceptance.
